Agreement to Terms
By accessing or using the services provided by WaterPenetration.ca, a subdivision of AnyLeak.ca, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.
Description of Services
WaterPenetration.ca provides water penetration detection, building envelope diagnostics, leak investigation, and related services. Our services are inspection and diagnostic in nature and are designed to identify potential sources of water intrusion.
Service Limitations
Diagnostic Nature of Services
Our services are diagnostic and investigative. We identify potential sources and paths of water intrusion based on available evidence and professional assessment. Our findings represent our professional opinion based on conditions observed at the time of inspection.
No Guarantee of Complete Detection
While we use advanced technology and proven methods, we cannot guarantee detection of all water penetration issues. Some leaks may be intermittent, inaccessible, or not active during inspection. Our reports reflect conditions at the time of assessment.
Not Remediation Services
We provide detection and diagnostic services only. We do not perform repairs, waterproofing, or remediation work. Any recommendations in our reports are for informational purposes and should be evaluated by qualified contractors.
Client Responsibilities
Clients are responsible for:
- Providing accurate information about the property and observed issues
- Ensuring safe access to areas requiring inspection
- Obtaining necessary permissions for inspections (from strata councils, tenants, etc.)
- Informing us of any known hazards at the property
- Acting on findings and recommendations in a timely manner
Reports and Documentation
Reports provided are for the exclusive use of the client who commissioned the inspection. Reports may not be shared with third parties or used for purposes other than originally intended without our written consent. We retain ownership of all reports and documentation.
Limitation of Liability
To the fullest extent permitted by law, WaterPenetration.ca and AnyLeak.ca shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:
- Use or inability to use our services
- Any decisions made based on our reports or recommendations
- Undetected water penetration or subsequent damage
- Actions or inactions of third parties
Our total liability for any claim arising from our services shall not exceed the fees paid for the specific service giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless WaterPenetration.ca, AnyLeak.ca, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.
Payment Terms
Payment terms are established at the time of service agreement. Unless otherwise agreed in writing, payment is due upon completion of services. We reserve the right to withhold reports until payment is received.
Cancellation Policy
Cancellations must be made at least 24 hours before scheduled appointments. Late cancellations or no-shows may be subject to a cancellation fee.
Intellectual Property
All content on this website, including text, graphics, logos, and software, is the property of WaterPenetration.ca or AnyLeak.ca and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of British Columbia.
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this website. Your continued use of our services constitutes acceptance of any modifications.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
